Organisations should consult with the pool of potentially redundant employees. The express purpose of the consultation is for employer and employee to consider all available options with a view to avoiding redundancy. Employers should speak with their staff directly, convening meetings on an individual basis to discuss circumstances.
If there is work elsewhere in the business group the employer should offer this to staff who are at risk of redundancy. An employee may lose their right to statutory redundancy pay if they unreasonably reject suitable alternative employment. Suitable alternative work might be work of a similar kind and no less favourable in relation to the other terms of employment such as remuneration, authority and place of work.
Where alternative work exists which is different from the employee’s previous job, the employee can trial the role for at least four weeks to decide if the role is suitable.
If the business anticipates making 20 or more employees redundant the length and manner of the consultation is specified at law. Otherwise, the employer should conduct a consultation of reasonable length in order to consider the options.
