If no other work is available and the employer has followed a fair selection process, then it will have identified which employees from the pool it needs to make redundant. The next step is for the employer to provide formal notice of termination of employment. The notice period is usually set out in the employment contract. If for any reason there is no employment contract, then the statutory minimum notice provisions apply.
It is usual for notice periods to be worked out by the employee, and across this period the employee is entitled to time off to look for alternative work. Some employers will terminate the contract earlier and make a payment in lieu of notice to the employee. In relation to the latter the employer will need to give consideration to any post termination restrictions that it wants to rely on.
